Terms of Service

    1. Introduction

    These Terms of Service ("Terms") govern your access to and use of the Giveawayz platform ("Platform"), operated by BOUNZ LTD (company no. 14283718), trading as Giveawayz ("we", "us", "our"). By accessing or using the Platform, you agree to be bound by these Terms.

    The Platform enables businesses ("Organisers") to create, manage, and run prize competitions, and enables individuals ("Entrants") to purchase tickets and enter those competitions.

    2. Eligibility

    You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you meet this requirement.

    Individual competitions may have additional eligibility requirements (such as geographic restrictions) set by the Organiser. These will be clearly stated on the competition page.

    3. Accounts

    To access certain features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

    You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

    4. For Organisers

    Organisers are responsible for ensuring their competitions comply with all applicable laws and regulations, including UK prize competition law, the Gambling Act 2005, and consumer protection legislation.

    Organisers must:

    • Provide accurate descriptions of prizes and competition rules
    • Include a qualifying question of sufficient skill
    • Offer a free entry route where required by law
    • Draw winners fairly using the Platform's provably fair draw engine
    • Deliver prizes to winners within a reasonable timeframe
    • Maintain appropriate terms and conditions for each competition

    Compliance tools are not legal advice. Giveawayz provides software tools and guidance (including qualifying-question builders, free-entry routes, an AI-assisted terms & conditions generator, and compliance checklists) to help Organisers structure their competitions. Where our AI drafts terms and conditions or qualifying questions, that output is a starting point generated from the details you provide — it is not pre-approved or legally reviewed. These are tools, not legal advice, and we do not warrant or guarantee that any competition, or any AI-generated content, is lawful or compliant. Organisers remain solely responsible for the legality and compliance of their competitions and should obtain their own independent legal advice before publishing.

    5. For Entrants

    By purchasing a ticket, you are entering a prize competition. Ticket purchases are non-refundable unless the competition is cancelled by the Organiser.

    You acknowledge that purchasing a ticket does not guarantee winning a prize. Winners are selected using our provably fair draw engine with cryptographic verification.

    6. Payments

    Ticket payments are processed securely by Cashflows, our payment partner. Card details are handled by Cashflows and are not stored by Giveawayz.

    Organisers receive ticket revenue into their own Cashflows merchant account. Giveawayz subscription and platform fees are billed separately. Card processing fees charged by Cashflows are the Organiser's responsibility and are not passed on to entrants.

    Refunds are at the discretion of the Organiser, subject to applicable consumer protection laws.

    7. Platform Fees

    Organisers pay a monthly subscription fee and a per-transaction platform fee. Current pricing is available on our pricing page. We reserve the right to change pricing with 30 days' notice.

    By providing payment card details, you authorise us to charge that card automatically each month for your subscription fee (where applicable) and platform fee, calculated in accordance with your plan's published rate. We retain your card details securely, via our payment processor, until your account is closed or you update your payment method.

    8. Intellectual Property

    The Platform, including its design, features, and content, is owned by BOUNZ LTD. You may not copy, modify, distribute, or reverse-engineer any part of the Platform.

    Organisers retain ownership of their competition content, images, and branding. By uploading content, you grant us a licence to display it on the Platform.

    Organisers warrant that they own or hold all necessary rights, licences and permissions for any content they upload (including images, descriptions and branding) and that it does not infringe any third party's intellectual property or other rights. Organisers are responsible for their own competition content and agree to indemnify us against any claim arising from it, in line with Section 10.

    9. Prohibited Conduct

    You agree not to:

    • Use the Platform for any unlawful purpose
    • Attempt to manipulate competition outcomes
    • Create fraudulent accounts or use disposable email addresses
    • Interfere with the Platform's operation or security
    • Scrape, crawl, or harvest data from the Platform

    10. Warranties, Liability & Indemnity

    No warranties. The Platform and all tools, guidance and AI-generated content are provided “as is” and “as available”. To the maximum extent permitted by law, we make no warranties or representations that the Platform, or any compliance tool, guidance or AI-generated output, will ensure that a competition is lawful or compliant with any applicable law.

    Limitation of liability. To the maximum extent permitted by law, BOUNZ LTD shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. We are not responsible for the actions of Organisers, including the legality of their competitions or the delivery of prizes, and act solely as a technology platform facilitating competitions.

    Indemnity. Organisers agree to indemnify and hold harmless BOUNZ LTD against any claims, losses, damages and costs arising from their competitions or their use of the Platform, including any breach of applicable law or these Terms.

    Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (including liability for death or personal injury caused by negligence, or for fraud).

    11. Termination

    We may suspend or terminate your account at any time for violation of these Terms. Organisers may cancel their subscription at any time, subject to their current billing period.

    12. Changes to Terms

    We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Platform. Continued use of the Platform after changes constitutes acceptance.

    13. Governing Law

    These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
